  If you research the original MO Ag Dept's Animal Care Facilities basic information, it states that dogs can be killed in accordance with the AVMA's Panel of Euthanasia guidelines.  That's a HORRIBLE bunch of information, as it allows just about any method and gives the instructions on how to do so properly.  It does include "gunshot"  (http://www.avma.org/issues/animal_welfare/euthanasia.pdf ).

If this easy deal the puppymiller's lawyer worked out, what would he have gotten for "punishment" or a misdemeanor or a felony?  Why do most court decisions not even take into consideration the suffering of the dogs but lean toward helping the miller who is probably a "good ole boy" friend of the judge.

The prosecutors did not seek maximum punishment of this grotesque puppymiller "because of his health issues, he did not need to go to jail."  Well, wasn't it kind of the incompetent prosecutors to take pity on this con artist?  He broke animal cruelty laws for 104 dogs and he didn't need to go to jail?  This monster of a man's "health issues" is gluttony and he doesn't know when to stop eating.  I'm willing to bet he weighs over 400 pound while the dead dogs found on his premises probably starved to death".

  Dear Auntie J -

I threw up twice yesterday so today Mom and I took a trip to the vet. My doctor loves animals and is very compassionate but he poked and prodded every inch of my body. He did all kinds of bloodwork and other tests but gave me a good report that nothing was wrong with me. He told me I was a perfect specimen for an 11-year old dog and was so easy to work on because I am a so cooperative. He knew all about my heart surgery at LSU Veterinary Hospital when I was 16 weeks old. He even mentioned today that he saw Mom and me on television when the evening news had a human interest story about my heart problem at that time. He couldn't get over how active and frisky I am for an 11-year old and said my heart is as sound as a dollar. I have remained the same sweet pup that I have always been and I still love all people and all cats and dogs. I have not had one sick day since my heart surgery and the doc and I think I threw up because Mom gave me two tiny dog biscuits that I had never had before. Those biscuits have been thrown away. Just thought I would write and send you an update to let you know that I am as charming as ever and still have a great personality.

Who is this martyr being paid $100 million for his talents of being a convicted felon, a person of no moral character and a killer of dogs he trained for dog fighting?  He hasn't discovered a cure for cancer or found a solution for starving children in Africa or India like Mother Teresa or performing any altruistic actions for the less fortunate.  He gets all this money for throwing something as insignificant as a football.  Where are our priorities?  Will his next reward be the medal for the Nobel Peace Prize? 

 

  Prop B or The Puppy Mill Cruelty Prevention Act was passed by voters in Missouri. Now legislators are working to repeal the newly passed law and they are misrepresenting the facts to constituents and their colleagues. There was no "compromise" on B. It has been REPEALED.   Notorious Missouri Puppy Mill Closes its Doors

Last year, The HSUS released a Dirty Dozen report of some of the worst puppy
mills in Missouri—the state with the highest concentration of these high-volume
dog-breeding operations. Our report catalogued a raft of violations of the weak
state and federal rules and showed a pattern of negligence and neglect.
Among the most egregious entries on our Dirty Dozen list was S&S Family Puppies,
a puppy mill with more than 500 pages of enforcement records documenting dogs
underweight, with oozing sores, and with untreated injuries. The records showed
that the dogs lived in cramped and filthy conditions and had inadequate
protection from harsh weather. Despite this appalling mistreatment, the kennel
had maintained its license—until now, that is.

This month, Missouri’s Attorney General, Chris Koster ordered S&S Family Puppies
to close its doors. We hope this is just the start of an effort to crack down on
the many inhumane and substandard breeding kennels in Missouri, especially the
chronic violators that have demonstrated so little respect for the law or their
dogs.
The Stephensons’ dogs, however, are not going to rescue groups or shelters where
they could be adopted into loving families. Instead, the state is allowing them
to be transferred or sold to other commercial breeding facilities. Forty of the
dogs are scheduled to be sold to the highest bidder this Saturday at the
Southwest Kennel Auction in Wheaton, Mo.
And because only the Stephensons were mentioned in the Attorney General’s
statement, we suspect many of these dogs may be transferred to a second kennel
operated by another family member, Brandi Cheney. USDA records list Stephenson
and Cheney as co-owners of S & S Family Puppies. In fact, last year several
aggrieved consumers sued Diana Stephenson and Cheney under the Missouri consumer
protection law. The consumers alleged that Stephenson and Cheney sold them sick
puppies but misled them into believing the puppies were healthy. A copy of the
plaintiffs’ complaint was sent to Attorney General Koster.
Nevertheless, as detailed in our March 2011 Dirty Dozen update, Cheney recently
obtained a USDA license for a new kennel, called Circle B Farms, which has also
been cited for severe animal care violations.
Thus, the surviving dogs likely won’t have a chance at a better life, but merely
a life in another puppy mill. This is unacceptable. Puppy mill operators who
have repeatedly violated both state and federal laws should not be permitted to
move or sell their surviving “stock” to other puppy mill operators. The dogs
have already suffered untold trauma and should not be transferred to another
breeding facility, especially considering that local and national animal groups
are prepared to help these dogs. It’s time they find a loving home.
 
 
Isn't it sweet of the judge to give these puppy millers a 17-month deferment to get their ducks in a row?  After all, they were only pleading guilty to 5 counts of cruelty for 250 dogs that were seized way back in 2007.  Seems like 4 years of no court sentencing should have been long enough.
For the time being, they will have to serve the dreaded community service.  Let's hope it's 17 months of cleaning port-o-lets.

"One licensed breeder in Ohio, with no veterinary qualifications, operated on a pregnant dog without anesthesia; the breeder delayed calling a veterinarian and the dog bled to death. The inspector also found that 40 percent of the (200) dogs in the kennel were blind due to an outbreak of Leptospirosis. The inspector determined that the facility’s water was contaminated and had caused the outbreak."

1,200 dogs buried on farm near Oberlin Dec 2010 “the infected pups originated from a large breeding facility in” Kansas and it quoted Paul Grosdidier of the KAHD who reported “We know the facility did sell puppies to at least one Wyoming pet store where cases came out of it. Whether all the cases originated from Kansas, we are not absolutely sure.”

 
 
I equate Michael Vick's lack of moral character and true personification of pure evil right up there with Darth Vader.  I guess the artsy community of Virginia will be honoring the 9/11 plotters of the Twin Towers for the 5,000 Americans they successfully killed.

A commercial kennel owner in New York destroyed 93 dogs using a hose connected
to a farm engine and pumping carbon monoxide into a makeshift "gas chamber."

David Yoder, owner of Black Diamond Acres kennel in Romulus, told a U.S.
Department of Agriculture inspector during a July 15 inspection that he killed
the dogs to "depopulate" the kennel.

Yoder said he created an airtight chamber out of a wood whelping box (where
nursing puppies are typically housed with their mothers) by fitting the opening
with a metal door with a small hole for an exhaust pipe which was attached to a
3 horsepower farm engine.

Then he gassed "approximately" 78 adult dogs and 15 puppies in groups of five or
six. Yoder said he left the barn during the gassing because he had a headache
from the fumes. He also said he used a stethoscope to make sure the dogs had
stopped breathing before burying them, according to the inspection report.

It is against federal law for a licensed kennel owner to perform their own
euthanasia. The inspector, Andrea D'Ambrosio, also noted that dogs not
immediately gassed likely suffered from inhaling the excess fumes.

"The manner of mass euthanasia caused potentially high levels of behavioral
stress and unnecessary discomfort to all the dogs in the kennel," the report said.

Mary Anne Kowalski, a board member of the Seneca County SPCA, said she was not
aware of anyone from the USDA reporting what she believes is a clear case of
animal cruelty to local authorities.

The dogs were killed sometime after a June 29 inspection where Yoder had been
ordered to get his dogs tested and treated for Brucellosis (after earlier tests
indicated some of his dogs had the contagious disease) and before the inspector
returned on July 15.

The case bears an eerie resemblance to the 2008 mass shooting at a Berks County,
Pa., kennel after the owner was told to treat his dogs for flea infestation.
That incident helped propel the passage of the new state dog law and the
immediate prohibition of euthanasia by any means other than by a licensed
veterinarian.

Romulus, located 60 miles southeast of Rochester in Seneca County, may have been
the first municipality in the nation to ban puppy mills when it passed an
ordinance last year outlawing commercial kennels.

Seneca County has a sizeable Amish population, and many are involved in dog
breeding, Kowalski said. Yoder, who is Amish, bred poodles, Bichons, Maltese and
Boston Terriers. He was allowed to continue operating his kennel in Romulus
despite the ban because it was grandfathered under the new ordinance.


Kowalski, who discovered the report of the gassing on the USDA website while
updating her files today, said she was stunned at what she read. "I just lost
it," she said.
Kowalski said she reported the incident to the sheriff and district attorney in
the hope that cruelty charges will be brought against Yoder.

Yoder's address is pubic record, it's on the USDA forms: 5929 Rt. 414, Romulus, NY 14541.

This puppymill must have been extraordinarily bad to warrant a seizure in the state of Misssouri.  In the meantime, the humane society will have to pay for the entire care and rehabbing of the dogs until the court hearing Feb. 28.  These millers make hundreds of thousands of dollars off the selling of dogs so I hope an intelligent judge hears the case for a change and sends this guy to jail and hits him with an enormous fine.  Hopefully, all these pitiful dogs will find good loving homes.  This article is split in the middle with a reminder about Facebook, so keep scrolling down for the entire story.

This article failed to supply the name of the company or corporation that has given Vick his first paid endorsement, but when I find out who it is you can bet I will refuse to purchase any product or service they sell.  It still boggles my mind that so many are overlooking what he did simply because he can throw a football.  The way he killed his losing fighting dogs by shooting, drowning and hanging them is not my idea of humane euthanasia.  He wanted them dead but apparently did not want to pay a vet to come out to his mansion and inject the injection that would have been humane.
 
 
These people didn't start out breeding as a "hobby".  Anyone who has 800 small-breed dogs they sell online for $1,000 each can't be a hobby breeder.  This is called a puppymill with a very lucrative income derived from cruelty to animals.  The above article was published 12/10/10 but I haven't seen an update on it so don't know what kind of sentence these jerks got, if any.

It's me, Joey, the editor of PMR puppymill news.  I just wanted to tell you that news has been slow lately about mills except that #1 Missouri and #2 Oklahoma lawmakers are considering repealing recent laws passed to crack down on the horrible mills in their states.  I hope this does not go through because we need to do something about these horrible places.  I also hope the reason the news about them is slow is because they are being raided and closed down and all these vile people are going to jail.  I haven't seen any recent reports about any that have gone out of business though. 
 
I turned 11 years old this month but Mom says I am still the frisky, charming puppy I was the day I was delivered to her.  She says I will never grow up.  She also says it is because I am so spoiled.  In fact, I am lying in the middle of her bed as I write this.  I do allow her to sleep with me.  My best friend, a huge Labrador named Dusty and I spend most of the day playing together.  Dusty loves me and is very gentle in our rough-housing.  She also keeps the inside of my ears clean.  I am so glad PMR rescued me and found me this good home where I am King among all the dogs.  My Christmas was good and Santa Paws was good to me.  I had a stocking filled with toys hanging on the fireplace mantle and also had some presents I was allowed to unwrap myself.
 
Well, I have to go to bed for now.  Just wanted to report in.

FYI, Best Friends Animal Sanctuary in Utah is the largest no-kill facility in the nation and has a superb reputation with rehabilitating animals that have been abused and/or suffer from serious social or medical problems.  When the original story of Michael Vick's abuse of his "fighting dogs" broke and he had been exposed for killing many of his dogs by hanging and electrocution, Best Friends staff traveled to Virginia and rescued many of the surviving dogs that had escaped Vick's warped idea of euthanasia.  I personally believe that President Obama's phone call congratulating the owner of the Philadelphia Eagles for giving Vick a "second chance" was an insult to any dog lover and especially those of us who have worked so hard throughout the years to abate cruelty to animals.  Unfortunately, Vick did not give a number of his dogs a second chance.  If you care about eliminating cruelty in any form for humanity or animals, I believe you will enjoy the article at the above link.

1,200 dogs buried on farm near Oberlin

Some of the details became public Tuesday in canine tragedy in Decatur County that came close to involving Barton County this week.
According to state records, it was Jeff Fortin, of Beaver Creek Kennel, outside of Oberlin in northwest Kansas, who received the state permits to dispose of dog carcasses on rural property that he owns.
The permit was received Dec. 6, and a KDHE letter was sent out Dec. 8, outlining the “authorization #635, disposal of solid waste without a permit located in ... Decatur County. Disposal of unprocessed livestock carcasses (canines).”
This issue surfaced locally on Monday morning when it was discussed by the Barton County Commission.
County Administrator Richard Boeckman told commissioners that Landfill Manager Mark Witt had contacted him last week, explaining that, since Barton County maintains a state-approved regional landfill, he’d been contacted about this situation that had developed near Oberlin, the county seat of Decatur County in northwest Kansas, just south of the Nebraska border.
Witt had been contacted by state officials from the Kansas Animal Health Department about the probable necessity of disposing of 1,200 dog carcasses.
The dogs were in the process of being euthanized after being removed from a huge breeding facility, Witt had been told. Boeckman said it had been reported that the sound of the dogs barking could be heard miles away from the dog site.
The KDHE communication states that the issue was closed before the Barton County Commission discussed it, noting the state “application does not indicate when disposal was scheduled to begin, but that disposal will end by Dec. 10.”
Decatur County Attorney Steve Hirsch said Tuesday afternoon that when the permits were processed at the county level, there was no indication of the scope of the disposal.
Hirsch typed on the solid waste application form, where local government officials are to sign off, a note about Decatur County regulations: “No zoning exists for sites outside the city of Oberlin, so no local approval needed.”
And where the form was signed by the Decatur County Commission chairman, it was typed, “Signed but not approved as no approval needed from county.”
Hirsch said he did not find out about the scope of the disposal until this week.
Repeated phone calls from the Tribune to the Kansas Animal Health Department Animal Facilities Inspection were not returned.
Tuesday afternoon, a receptionist for the state department said the director of that department was “in meetings” and was “not accepting calls.”
There has been no official statement regarding why the dogs were euthanized.
Decatur County officials were looking Tuesday at a University of Wyoming website news release, dated Tuesday, that reported on a Wyoming State Veterinary Laboratory and Wyoming Livestock Board investigation into canine distemper in puppies that had turned up from late summer into the fall at Cheyenne, Laramie, Casper and Douglas, Wyo.
A Wyoming official reported that distemper was confirmed in 24 purebred dogs that had been purchased from pet stores in what was called by one of the officials “the largest outbreak of canine distemper I’ve seen in Wyoming in my 21 years at this laboratory.”
The report added, “the infected pups originated from a large breeding facility in” Kansas and it quoted Paul Grosdidier of the KAHD who reported “We know the facility did sell puppies to at least one Wyoming pet store where cases came out of it. Whether all the cases originated from Kansas, we are not absolutely sure.”
Grosdidier is the KAHD official who had contacted Barton County about the possible use of the local landfill for the disposal of 1,200 dog carcasses
 
 
Take note that this breeder who once had 500 dogs admits she had to close down because she can't make a profit if she has to abide by the new regulations.  Hip, hip, hooray for the dogs!
 
 
This puppymiller should have been sentenced to 100 years, not a 100 days (reduced by 50 days to community service).  The fine was ridiculous too.  Can you imagine what these dogs have endured in open pens in the severe weather of Washington state?  I communicate with an old friend in Tacoma, WA and she says the weather there is terribly severe with snow piled high.
 
 

 

 

 

 
 
And people wonder why I have dedicated most of my life to helping homeless and abused animals.  It's stories like this that keep me going.  The dog in the photos was actually found in a ditch in Laplace but is now being cared for in a shelter in Houma.
 
 
 
Wayne Pacelle missed one vital point in his rambling article which also promoted HSUS.  It is not only neighbors and the FBI that would benefit from an Animal Abuse Registry.  It would be a tremendous boon for humane societies and rescue groups to have access to this Registry and prevent animal abusers from ever being able to adopt an animal.
 
 
 
Out of 443 neglected and malnourished dogs, the millers were only charged with 8 counts.  As usual, they were only sentenced to community service, restitution and not having any more animals.  This must be a family created by the devil - even their daughters were involved.  One of their daughters also runs a puppymill where she had 155 dogs, 87 of them hidden away in the attic.  Why none of these people were not sent up the river, I'll never understand.  The worst kinds of criminals are the ones who can't defend themselves.

The news report states that this woman had an unsavory reputation for breeding dogs and in past history had as many as 100 dogs.

I don't know what it takes for a judge to take these crimes seriously.  To return dogs to these abusers is condemning them to a lifetime of cruelty however short that lifetime might be.

  Someone on Face Book recently posted pictures of Don Yousey posing with dead animals he killed. As you know, Yousey is in charge of killing companion animals at animal control and his hobby is clearly, killing other animals for fun. So, taxpayers pay Yousey to kill animals and then he goes out and kills more animals "just for fun" !!! The deer, antelope, bear and pig were alive and happy until Yousey shot them. Then they bled and died "just for fun" !!!

So, Don Yousey enjoys killing animals. Is it any wonder that there is no compassion or concern for the unlucky dogs and cats that end up at Brunswick County Animal Control?? Now we know why so little thought was given to buying the used gas chamber !! Should we be surprised to learn that cruel handling and cruel killing of dogs and cats is common place??

What else is the vet going to say considering she is on puppymiller Derbe Eckhart's payroll?  I would think the vet could get into a whole heap of trouble for not reporting the abuse that undoubtedly occurred to 800 dogs.
 
I think it is a crime that the SPCA only rescued 60 of the 600 animals this miller had on the premises.  It certainly indicates a lack of compassion from the SPCA who could have cleaned the place out and distributed the animals to other sanctuaries.  So what happens to the remaining 540 unfortunate animals who have lived their lives in that hellhole?  What a farce of a raid.

Seems these millers were dealing in only small dogs.
 
While it is way past due for USDA to crack down on puppy mills.  This story, however, is not as good as it sounds.  The puppymiller is being allowed to keep her animals as "personal pets" and she can still sell over the Internet.  She will also be allowed to re-apply for a license in two years.  But at least she's out of business for now.

  Bill Smith has dedicated his life to fighting "puppy mills," the warehouses where dogs are raised for profit in tiny cages, denied sufficient medical care, and often killed when they get sick or can no longer breed. Smith noticed that many of the farms around his shelter facility, near the heart of puppy-mill country in Lancaster County, Pa., were displaying signs boasting that they were or-ganic dairy operations.
   
 
 
This woman has been in business since 1967.  I can't even begin to imagine how

many thousands of dogs have died and suffered tremendously under her "care".

Sheriff's Office gave warning after warning after warning to clean up their breeding business....and now the breeders and dogs have disappeared.  How many "warnings" have to be given in MO before action is taken and the millers hotfoot it out of town with dogs?  I believe the Keystone Kops could have done a more proficient job.
 
 
This case should be interesting:  The miller's breeding license was revoked last March and the license of his veterinarian has been suspended.

This news article omits certain info.  I recall this raid where dogs were even found living in shopping carts but can't remember what breeds of dogs were involved.  The puppy mill was located in Washington State and named Sun Valley Kennel which I found by googling the miller's name. There were 400 dogs rescued by the Sheriff's Department and volunteers at this mill.  There are several Sun Valley Kennels in the U.S. but none were listed under Google in Washington so I assume their website has been removed.  At least the dogs, whatever breed, are finally safe now.
   
 
 
 
I find it incomprehensible that a Benton County official wants to leave these 300 American Eskimo dogs at the puppy mill until the case is decided - whenever that might be.

McLennan County sheriff’s officials has said up to five dogs were being held in rabbit cages caked with feces up to 6 inches high. Sheriff’s officials have said it is one of the worst cases of animal cruelty the county has seen.

James Van Winkle, 66, is out of the McLennan County Jail after posting $10,000 bail. He was arrested Friday and charged with animal cruelty in the case. His wife has not been arrested.

Deputies found a 55-gallon barrel filled with decomposing dog carcasses, and another full of dead goats. Also on the property was a dirt pile with goat legs sticking out the top.

   
  "On one animal, we removed a pound of wet fecal matter," Fraser said. "At least four animals couldn't use their legs properly or defecate normally. The degree of matting on these dogs I have never seen before."

I wonder why provisions pertaining to rescuing and fostering animals were stripped from the bill.  OK is the 2nd largest puppy mill state in the country, right behind Missouri.  So I guess it's a start in OK.

Bullfeathers!  These dealers in animal flesh have made thousands and thousands of dollars selling these unfortunate, abused dogs to the public and probably have huge bank accounts. ( or look under the bed IRS )  Between these 4 relatives involved in the seizure of 550 pitiful dogs, a total of 10 charges have been filed against them.  What kind of stupidity is that?  They need to pay huge fines and go to jail for 10 years each so they can learn what it is like to live in a cage and be neglected. If they get a slap on the wrist, they will go right back into business.

This is just horrible. All Yorkies. I thought you might want to see these. Be prepared to cry. I wish they'd show these types of videos on TV to the general public. Maybe then, they'd sit up and take notice and realize that yes, this is actually happening right now in this day and age.
 

 
 
 If what little bit of water the animals had in bowls was frozen, how many dogs and puppies were also frozen?  The Sheriff suspects the malnourished tiger was feeding on puppies since puppy carcasses were found in the tiger's pen.  The original estimate of number of dogs/puppies seized was 200.  The number has now been increased to over 300 according to this article. Initial estimates put the number of dogs at close to 200, but the number found continued to rise as officers searched kennels and barns across the property. The dogs were taken to the St. Louis Humane Society.

The tiger was tranquillized, given an IV and taken directly to the Dickerson Park Zoo. It did not appear to be ill.

“It was just malnourished, malnourished to the point that they figured it weighed about 175 pounds and it should be weighing over 400 pounds — the age and bone structure that it was,” Copeland said. “There were some carcasses of dead puppies in the tiger’s pen, which indicated to me that’s what the tiger had been eating.”

 Click on the thumbnail photos to view these luxurious "kennels".  I tried to find any websites this Virginian Thornton had on the Internet advertising dogs and there were some links - but when I tried to pull them up, they had all been removed.  Seems this raid took place on 2/06 and is just now making national news so I guess it didn't take the millers long to remove the sites.

County paper yesterday.

My intentions are to teach as many people as I possible can that its
not ok to buy from a puppy mill or to associate with those kinds of people
at all.
  A puppy mill operation in Wakulla County, FL was reported to local law
enforcement in early September of last year. More than 200 dogs were
on the property belonging to Wallace and Cathy Bailey. The County has legal
authority to remove every single one of those dogs from the horrendous
conditions they are suffering in, but chose not to do so. According
to the  local newspaper, in spite of finding the dogs in "deplorable"
conditions, officers were reluctant to seize the animals because the county animal
shelter is incapable of housing so many dogs. Instead the dogs have
remained in the custody of the Baileys until this matter was finally
heard by a Judge. In spite of testimony that the dogs were severely matted,
kept in wire cages that allowed their feet to fall through, had water
bowls full of algae and mosquito larvae, lacked proper shelter from the elements-
the Judge issued an order on January 23, 2009 allowing the Bailey's to
keep 50 of these severely neglect dogs-even though doing so violates the local
zoning law. The order, pasted below, required that the Baileys remove
150 dogs from the property under the supervision of Animal Control.
However, the Defendants have reportedly locked the gate that allows access to their
property and refuse to allow Animal Control on the premises to
inspect. In spite of the horribly neglected conditions of the dogs NO CRIMINAL
CHARGES HAVE BEEN FILED. In spite of the fact that the Judge's order
specifically finds the dogs have inadequate housing, and the fact that it was 25
degrees in Wakulla County last night, the dogs are still languishing in
outdoor cages.

Local rescue groups and national animal welfare organizations would
help house the animals pending final resolution of this matter and provide
the animals with much needed veterinary care at no expense to the county.

Please speak up for the abused dogs. Take a few minutes to contact
the Wakulla County officials that have the authority to help these
animals and POLITELY communicate:

1: Thank you for your efforts thus far on behalf of the Baileys
neglected and abused dogs

2. Please be more proactive in getting the animals to safety by using
your authority to seize the animals-they have suffered far too long already

3. Please work with local and national animal welfare organizations
to find safe and responsible foster homes for these neglected animals until
this matter is finally resolved-the animals need and deserve immediate
medical attention and to be out of the cold

4: Please pursue criminal charges against the Baileys for their
multiple violations of the state law prohibiting animal cruelty

Also POLITELY ask Judge Walker to reconsider her decision allowing the
Baileys to keep 50 dogs in light of the findings in her order and
that the  Baileys refusal to cooperate with Animal Control after her order was
entered. If she does not amend her order the remaining dogs will
continue to suffer and the County will have an ongoing enforcement nightmare.

Below is the full order :

This cause come on for evidentiary hearing upon plaintiff's Petition
for Order of Disposition or Order to Provide Care. The evidentiary
hearing was held on Dec. 9, 2008 after continuances for settlement negotiations.
Defendants retained John James who appeared at the time of trial,
Wakulla County Animal Control was represented by the County Attorney Ron
Mowrey.
During the course of the evidentiary hearing, defendants repeatedly
disputed that current conditions at the subject location were the same as
originally discovered and as the plaintiff's witnesses testified. Defendants
asserted that the conditions that gave rise to the complaint had been
rectified and that the animals were provided for adequately and not subject to an
neglect or cruel treatment.

By agreement of the parties, a visit to the subject property was
arranged for the morning after the hearing, at which time both parties were to
photograph current conditions to be filed as a supplement to the
record within 15 days. Within this time frame, defendants filed a motion to
continue the time for an additional 30 days because their counsel Mr.
James was ill. The motion failed to meet the requirements of the rules as
noted in
the objection of Animal Control, nevertheless the count has reserved
judgment for the requested 30 days to allow defendants' attorney to
respond, or in the alternative to hire a new attorney. The defendants have
failed to do either; they have failed to file any photographs; and continue to
file pleadings that are a nullity. Accordingly, the court having reviewed
the pleadings, received testimony of witnesses and exhibits, reviewed
photographs of animals, and heard arguments of counsel and otherwise being fully
advised in the premises, males the following finding facts:

1.) Defendants have neglected and mistreated animals in the operation
of a facility commonly known as a "puppy mill" which routinely houses over
150 animals.

2.)the dogs are kept in cages that are inadequate to be called
shelters. In many respects, the cages are dirty, containing feces that have been
left there for a long period of time due to a lack of cleaning. The
shelters do not provide adequate protection from he elements, especially when
considering the size and breed of the dogs that the defendants keep.
Further, the shelters do not provide acceptable footing for many dogs
as the metal grates used allowed the animals feet to pass partially through.

3.) The animals are often overcrowded. Some larger dogs are kept in
small enclosures making it difficult to maneuver. More than 150 dogs are
kept on the property with only Mrs. Baily providing full time care and with
only part time assistance. The number of dogs would require four additional
full-time employees in the opinion of Dr. Faith Hughes, the
veterinarian, who was immediately called to the scene by Animal Control.

4.) Inasmuch as the number of animals at the facility cannot be
adequately cared for by the defendants, the defendants must reduce the number of
animals at the facility so that they may be adequately and humanely
cared for.

5.)The defendants maintain no comprehensive bookkeeping procedure or
tag system that allow them to keep up with which animals have been
vaccinated or other important veterinary records.

6.) Despite several months of working with Animal Control, the
animals are still kept in inadequate inhumane unsanitary conditions, including
dogs having feces or bugs in their food or no food. Old feces pervade the
property where the animals are kept. Mounds of old newspapers are in
the bottoms of some of the cages. At the time of the initial visit, many
water bowls were dry or the water contained green algae and/or larvae.

7.) There is not evidence that many animals are not given any or
alternatively, adequate veterinary care. Dogs continue to show
observable medical neglect including matted hair, evidence of strokes, skin and
eye problems.

8.)Many of the dogs are not allowed outside of their enclosures for
adequate exercise and have had no quality interaction with humans. A few dogs
showed a marked fear of human contact from a lack thereof in their care and
raising.

9.) The defendants have operated the Wakulla facility and engaged in
breeding since 1977 by their own admission and have not obtained the
proper licensing to operate such a facility.

According this Court orders as follows:
1.) This court has jurisdiction of this matter to remove animals from
custody and to provide care when animals have been neglected or
mistreated pursuant to Section 828.073, FL Statutes.

2.) Each side was given and equal opportunity to present its case in
this manner.

3.) This hearing was conducted in accordance and compliance with
applicable Florida Statues and Wakulla County Code Provisions.

The man "AGREES" to spending a whole week in jail and paying a fine for running the worst puppy mill in the state of Maine?  You mean he had a choice?  Also, the judge will drop all the 20 animal cruelty counts he still has if he will stay out of trouble until the end of the year 2009?  Wow!  What a reward!  He should be able to start right up with manufacturing assembly line puppies the day he gets out of jail.

Montcalm County has a sadly outdated animal control facility that still gasses the unlucky souls within its confines.  Unfortunately, however, Liz was not gassed. The ending of her story still has yet to be told, and the fate of her remaining days is most certainly an exercise in painful torture.

Please do not send companion animals to research laboratories. I implore you
to cancel the county's contract with R & R Research, Inc. and never again
engage a Class B dealer to dispose of homeless animals.

Behind a lab’s closed doors, animals undergo invasive surgeries, toxic
dosing, food/water deprivation, and prolonged pain. Still, your taxpayers
subsidize pound seizure whether they like it or not. They indirectly fund
animal tests that delay medical progress with misleading results.

It is particularly irresponsible to support animal research when strides in
in-vitro technology, computer automation, and many more animal-free methods
now uncover data relevant to human health and safety.

Clearly, there is no altruism in dealing cats and dogs for research. There
is only profit. In 2006, USDA records reveal R & R Research of Howard City,
Michigan grossed $196,723 from the sale of 621 dogs and cats. Moreover, R &
R flaunts an unethical history. A 2006 USDA citation shows R & R illegally
transported dogs chained to a livestock trailer. In 2005, R & R was cited
for procuring dogs and cats from Howard City, where there is no pound.
Apparently officials sold their strays to R & R.

Before that, the Michigan Attorney General ordered R & R to pull its "animal
shelter" listing in the yellow pages. In the 1990s, a WOOD TV investigative
video portrayed R & R owners gassing animals in a corroded "CO2 barrel."

At the very least, Montcalm officials ought to be embarrassed by their
relationship with a Class B dealer. I strongly encourage you to terminate
your contract with R & R and permanently stop pound seizure -- a shady
practice abandoned by most counties nationwide.

This issue has generated worldwide publicity via the Internet. I look

It breaks my heart what the dogs go through at the cruel hands of the puppymiller profiled in this news article.  What can the dogs and puppies be going through as you read this with the current weather in MN?  I would imagine a number of these poor animals will freeze to death.  Mass breeding seems to be supported by Professors at the Un. of MN along with the Veterinary Medical Association and others.  It's as if MN is a Third-World Country with no compassion and no intelligence.  It's a lengthy article but please read.

This is an update.  This miller had 800 dogs and 350 puppies in 32 breeds.  As usual, the USDA refuses to release any info on this case.  The vet in this article has very little use for USDA and its policies.  What this miller has done to her "stock" is not unusual although it is terribly cruel.

"As horrible as it is to say this, I would rather see these poor dogs dead than living out their lives in a puppymill suffering day in and day out for all of their lives.  I can't think of a more cruel destiny for dogs than to live their lives in mills - especially those of the Amish.  These two brothers are quoted as saying they are now out of the business.  Don't believe it.  They might not have electric lights or drive cars, but they sure like the modern money that comes from selling sick and poorly bred puppies. "

Authorities said the raid at the farm of Patricia Adkisson was the largest in Tennessee's history. The investigation was so massive, officials said it could take a couple of days.

About 700 animals were found at Pine Bluff Kennels. Officials called it a puppy mill. Most of the dogs were smaller breeds.

This case might be a "warning" if the puppymiller had been totally shut down and NOT allowed to keep 25 breeding dogs, plus not being forced to pay the $57,500 it cost the Lancaster Humane League to care for the seized animals.

WZTV, 05/15/08 Nashville Brittany Bergez Will Serve Time in Jail for Animal Cruelty. A Westmoreland woman accused of animal abuse will also spend time behind bars. Brittany Bergez pleaded guilty today to two counts of animal cruelty. More than 40 dogs were seized from her kennel.. which investigators call a puppy mill. Bergez will serve two weekends in jail be on probation for two years and pay an animal welfare group one thousand dollars.
During her probation she can only keep two horses and two house pets.
